By creating a MustHaveMenus account, you agree to abide by these Terms of Use. The Terms are updated from time to time so please check back for changes that may impact you.
1. Basic Definitions
The MustHaveMenus website ("Site") is a subscription service that provides downloadable media along with web-based editing and publishing software (collectively known as "Services"), for use by paid subscribers ("Account Holders"). The Site and Services are the wholly-owned, copyrighted property of MustHaveMenus Inc. ("Company"), and are subject to U.S. and international copyright protection laws. MustHaveMenus is trademarked.
2. Requirement to Be in Good Standing
Usage rights ("Rights") are granted to Account Holders who have a current account with a valid username and password at MustHaveMenus.com. The Company may revoke privileges to anyone it believes is abusing the Site, as well as seek legal remedies necessary to protect its copyrights and intellectual property. Accounts may not be opened and canceled repeatedly to avoid charges.
3. MONTHLY ACCOUNT POLICY
The Account term is monthly, renewing automatically and continuously until canceled by the Account Holder. The Account Holder hereby agrees to accept the regular monthly fee charged to the credit card used to open the account. Partial months will not be refunded. To close an account, and prevent further monthly charges, at any time:
Log in, and click on My Menus. Next to your upcoming renewal date, click "Cancel".

4. Refunds
Our prices are low and we have a "no-refund" policy. If not satisfied for any reason, Account Holders may cancel an account to avoid charges for the next monthly term.
5. Content license from MustHaveMenus
All Account Holders are granted a non-exclusive, royalty-free license to use the Services to create menus, flyers and other promotional material for any restaurant, catering, hospitality, personal or charitable purpose, including any printed or online marketing purpose.
6. Menu Content License from Account Holder
By submitting menu content in the ordinary course of using the Services, Account Holders automatically grant MustHaveMenus a perpetual, royalty-free, and non-exclusive license to publish and promote approved ("opt-in") menu content from Account Holder to MustHaveMenus web properties and services, third-party social media sites, as well as to MustHaveMenus partner channels. Account Holders retain copyright and any other rights held in all restaurant or menu content submitted or displayed on or through MustHaveMenus and its partners.
7. Site Usage Restrictions
Crawlers, spiders, programmable scripts and/or other automated technologies may not be used to operate the Services or browse, search, or download templates and images. To protect against abuse, downloads may not be in excess of 100 per day per Account Holder.
8. Rights and Access Privileges Do Not Transfer
MustHaveMenus Account Holders are not allowed to transfer, share, trade or sell their usage Rights.
9. LIMITATION OF WARRANTY AND LIABILITY
MUSTHAVEMENUS INC. MAKES NO WARRANTIES AS TO THE FITNESS, CORRECTNESS, RELIABILITY, OR MERCHANTABILITY OF THE SERVICES OR SITE FOR A PARTICULAR PURPOSE. MUSTHAVEMENUS INC PROVIDES NO ASSURANCES OR WARRANTIES THAT THE SITE OR SERVICES WILL BE FREE FROM ERRORS, OMISSIONS, INCOMPATIBILITIES, INTERRUPTIONS, OR VIRUSES OR OTHER RISKS COMMONLY ASSOCIATED WITH THE USE OF COMPUTERS, SOFTWARE OR THE INTERNET. MUSTHAVEMENUS INC. HAS NO OBLIGATION TO SERVICE OR REMEDY ANY ASPECT OF THE SITE OR THE SERVICES; AND HAS NO OBLIGATION TO ASSUME THE COSTS OF REPAIRS OR SERVICE TO USERS' HARDWARE, SOFTWARE, OR OTHER EQUIPMENT IN THE EVENT OF ANY CLAIMS OF DAMAGES.
IN NO EVENT WILL MUSTHAVEMENUS INC., ITS OFFICERS, DIRECTORS, AFFILIATES, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, ECONOMIC, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SITE OR SERVICES, EVEN IF MUSTHAVEMENUS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
ALL CLAIMS RELATED TO THESE USAGE TERMS SHALL BE HEARD IN THE COUNTY OF JACKSON AND WILL BE GOVERNED BY THE LAWS OF THE STATE OF OREGON.
